Aqua Guardians Lifeguard Services – Waiver of Liability, Release and Indemnity Agreement

This Waiver of Liability, Release and Indemnity Agreement (“Agreement”) is made between the

undersigned client (“Client”) and Aqua Guardians, a lifeguarding service operated by [Your Full

Name] and Nick [Last Name] (“Aqua Guardians”).

1. Acknowledgment of Risk

I, the undersigned, understand and acknowledge that the presence of a lifeguard does not eliminate

all risks associated with aquatic activities. Drowning, injury, or other incidents may still occur even

with lifeguards present.

2. Assumption of Risk

I knowingly and freely assume all risks, both known and unknown, associated with aquatic

activities at my event, even if arising from the negligence of the lifeguards or Aqua Guardians.

3. Release of Liability

I hereby release, waive, discharge, and hold harmless Aqua Guardians, its owners, officers, agents,

and employees from any and all liability, claims, demands, actions, and causes of action

whatsoever arising out of or related to any loss, damage, or injury, including death, that may be

sustained by any individual during the event, whether caused by the negligence of Aqua Guardians

or otherwise.

4. Supervision and Responsibility

I acknowledge that Aqua Guardians lifeguards are provided to assist in supervising water activities

only. Parents and guardians remain responsible for the supervision of children outside the pool

area and for ensuring appropriate behavior around the pool.

5. Medical Emergencies

In the event of a medical emergency, I authorize Aqua Guardians staff to respond as trained. I

understand that Aqua Guardians staff may call emergency services if necessary, and I agree to be

responsible for any resulting costs.

6. Indemnification

I AGREE TO INDEMNIFY AND HOLD HARMLESS AQUA GUARDIANS FROM AND

AGAINST ANY LOSS, LIABILITY, DAMAGE, OR COST THEY MAY INCUR DUE TO

MY PARTICIPATION OR MY GUESTS’ PARTICIPATION IN THE AQUATIC ACTIVITIES PROVIDED.

7. Governing Law

This Agreement shall be governed by and interpreted in accordance with the laws of the State of

Texas.

BY SIGNING BELOW, I ACKNOWLEDGE THAT I HAVE READ THIS WAIVER OF

LIABILITY, UNDERSTAND IT, AND AGREE TO BE BOUND BY ITS TERMS.
